Firstly, so turns out the problem with the stutter everyone is experiencing is because of some limitation of the mkv container and the frame rate the broadcast was captured at, remuxing this into mp4 with subler managed to do the trick for me...

Then, just so everyone knows, the source is the BROADCAST version of the film - normally studios make them specifically in 16:9, and if the movie was shot in 16:9 and then cropped to 2.35:1 for the theatrical release, they usually open the mattes - think IMAX Blu-ray versions of films like Hunger Games 2 or TDKR. This was shot in a variety of aspect ratios (most in 16:9, some in 2.40:1) and then all cropped to whatever aspect ratio was needed (for the broadcast version - 16:9, for theatrical/DVD/Blu-ray - 2.35:1). So it's pretty safe to crop the image from 16:9 to 2.40:1 to crop out the subs completely while still keeping the theatrical framing - crop is different in some bits due to the 12 coming up in the top right and the location on screen titles. Compare the screenshots to the trailers :)

So if we get audio fixed up, remove that 12, and get foreign subs for 52-54 mins then we have a good version till retail/legit WEB-DL ;)
